The Empow'Her Global platform is an e-learning platform whose objective is to offer free open data training courses to feminist civil society organizations fighting against gender violence in order to strengthen their capacities, adapted to their needs and constraints.
The present Terms and Conditions of Sale and Use (hereinafter the “Terms and Conditions”) are entered into between the User-ice and the association EMPOW'HER, registered with the Registre du Commerce et des Sociétés de Paris under number 910 681 022, having its registered office at 82 rue du Faubourg Saint-Martin, Paris - 75010 (hereinafter referred to as “Empow'Her”).
Article 1 : Definitions
● E-learning: online training
● Module : an asynchronous learning unit belonging to the training program, defined by pedagogical objectives that inform the video capsules and the rest of its content.
● Online class : synchronous online training led by trainers and combining the content of several modules
● Users : members of feminist civil society organizations fighting against gender-based violence using the Platform.
● The Platform : the website providing asynchronous online training modules and information on synchronous virtual classes given outside the Platform. The Platform is offered by Empow’her.
Article 2 : Acceptance of terms and conditions
Use of the Platform implies full and unreserved acceptance by the User of the present Terms and Conditions. It is therefore the responsibility of the User to read these Terms and Conditions before registering on the Platform and each time he/she uses the services.
The present Terms and Conditions may be modified at any time by Empow'Her. The modified Terms and Conditions are applicable to any use of the Platform made after the modification. The User is therefore invited to consult the General Conditions each time he/she visits the Platform. If the User-ice refuses a modification of the General Terms and Conditions, he/she must no longer access the Platform and close his/her account.
The User accepts the present General Terms and Conditions by clicking on the box provided for this purpose when registering on the Platform.
The User is invited to keep a copy of these General Terms and Conditions on a durable medium.
In the absence of proof to the contrary, the data recorded on the Platform constitutes proof of all contractual relations between the User and Empow'Her.
Failure by the User to comply with these terms and conditions may result in suspension or termination of the User's access to the site.
Empow'Her reserves the right to temporarily or permanently exclude a User from the Platform in the event of serious misconduct, disrespectful behavior, or any behavior that would be detrimental to the proper operation of the Platform. Users are reminded that use of the Platform implies the observance of certain standards of behavior such as respect for others, good faith and courtesy.
Article 3: Registration
Registration takes place at the time of entry to the e-learning platform, without which the User cannot access the training modules.
Registration requires the following information:
- User's e-mail address
- User's first and last name
- Organization to which User belongs
- User's country of residence
Once registered, each User has access to an account which he/she is free to consult.
The User is free to unsubscribe from the Platform at any time by following the procedures on the Platform. The User will not be able to access his/her account and personal information. This information will be deleted after 30 days.
The login and password provided by the User are confidential, personal, non-transferable and non-transferable. Empow'Her cannot be held responsible for any fraudulent use of the User's login and password. The User undertakes to inform Empow'Her of any fraudulent use of the login and password as soon as he/she becomes aware of it.
Article 4 : The offer
Empow'Her provides open data distance learning via training content made available online on the Platform, offered by service providers. Training modules are available and presented on the Platform.
Alongside the modules, online classes are offered to Users. These online classes are delivered via Zoom, and information on how to participate is available on the Platform. These online classes are provisional: the date, duration, training content or speaker profiles may be modified.
Unless otherwise specified, each training module is available in French, English and Spanish. The time required to complete each training module is given as an indication only.
Empow'Her reserves the right to modify the training modules offered on the Platform, both in their general organization and in their nature and content. Empow'Her may provide, at the request of the User, any computerized proof of registration and follow-up of the distance training completed.
Article 5 : Course materials
The use of documents handed out during courses is subject to Articles 40 and 41 of the French Law of March 11, 1957: “Any representation or reproduction in whole or in part made without the consent of the author or his successors in title or assigns is unlawful”. Article 41 of the same law authorizes only “copies or reproductions strictly reserved for the private use of the copier and not intended for collective use” and “analyses and short quotations, provided that the name of the author and the source are clearly indicated”.
Any representation or reproduction, by any means whatsoever, that does not comply with current legislation constitutes an infringement punishable under Articles 425 and 429 of the French Penal Code.
Article 6 : Rules for using the Internet
The User who connects to the site declares that he/she is aware of and accepts the characteristics and limits of the Internet.
In particular, the User acknowledges:
- That he/she is solely responsible for his/her use of the Platform;
- That he/she is responsible for managing and storing his/her login and password, and that he/she is solely responsible for communicating his/her identification details;
- That he/she is aware of the nature of the Internet (technical performance, response times for queries or consultations);
- That he/she is responsible for ensuring that the technical characteristics of his/her device enable him/her to access the Platform and the virtual classes correctly;
- That it is the user's responsibility to take appropriate measures to protect and safeguard his/her own data and software from contamination by any viruses that may be circulating on the Platform.
Empow'Her undertakes to use its best efforts to provide uninterrupted access to the Platform, except in the event of a breakdown or technical constraints related to the specific characteristics of the Internet or the User-ice's network. However, the User-ice acknowledges that no one can guarantee the proper functioning of the Internet, and Empow'Her therefore does not guarantee the uninterrupted and error-free operation of the Module(s). In the event of an interruption of service by Empow'Her due to corrective maintenance, Empow'Her will make every effort to remedy the malfunction as quickly as possible.
The User-ice undertakes to inform Empow'Her of the discovery of a technical malfunction as soon as possible.
Consequently, Empow'Her accepts no liability for any direct or indirect damage arising from the use of the Platform and/or the Internet and/or viruses.
Article 7 : Intellectual property rights
All elements of the Platform belong to Empow'Her.
Any reproduction, representation or adaptation of the logos, textual, pictographic or video content, without this list being limitative, is strictly forbidden and constitutes counterfeiting and is liable to legal action.
Training modules are protected by copyright.
Any User who is guilty of infringement may have his or her account deleted without prior notice and without this deletion constituting any damage.
Any use by the User of the corporate names, trademarks and distinctive signs belonging to Empow'Her is strictly prohibited without the Vendor's express prior consent.
Article 8 : Responsibility
The User acknowledges that he/she is responsible for the use he/she makes of the training content, the implementation of tools and skills acquired during the training modules and virtual classes.
All direct or indirect consequences, such as loss of funds, mismanagement of projects, loss of commitment of beneficiaries, among others, are not the responsibility of Empow'Her.
Empow'Her can in no way be held responsible for any damage, material or immaterial, consequential or otherwise, caused directly or indirectly by the services provided, nor for any action taken by third parties.
Article 9 : Personal data protection
Empow'Her collects personal data in the course of its training activities.
The purposes for which personal data is processed are as follows:
(i) identification of Platform Users
(ii) quantitative and qualitative evaluation of the use of the Platform: number of connections, module completion rates, smooth operation of the Platform, etc.
(iii) measurement of follow-up indicators for funders.
The processing is based on the consent of the User wishing to access the training courses offered on the Platform.
The personal information collected by Empow'Her is stored in a drive to which access is restricted to team members, and is mainly used for the proper management and operation of the Platform, as well as to fill in indicators for monitoring the training program with donors.
The personal information collected is kept until 1 year after the end of the FON project, which shall not exceed the deadline of June 2026, unless the User-ice has exercised, under the conditions set forth below, one of the rights granted to him or her by law. These data belong to Empow'Her for the duration of the project.
The processing being administered in accordance with the provisions of Law No. 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties, as amended by Law No. 2018-493 of 20 June 2018, Regulation (EU) 2016/679 of 27 April 2016 of the European Parliament and of the Council on the Protection of Individuals with regard to the Processing of Personal Data and on the Free Movement of Such Data (known as the ‘RGPD’).
The User has the right to access, rectify and delete its data at any time, by contacting Empow'Her, 82 rue du Faubourg Saint-Martin 75010 Paris. [email protected].
In accordance with the essential requirement of security of personal data, Empow'Her undertakes, within the framework of the execution of its training courses, to take all necessary technical and organisational measures to preserve the security and confidentiality of personal data and, in particular, to prevent such data from being distorted, damaged, lost, diverted, corrupted, disclosed, transmitted and/or communicated to unauthorised persons.
Consequently, Empow'Her undertakes to:
- To process personal data only for the purposes described above;
- To give access to the data only to Empow'Her employees working on the FON project, who are authorized to process it by virtue of their position;
- The information collected may be communicated to third parties bound to Empow'Her by contract for the execution of subcontracted tasks necessary for the management of the training, without the User's authorization being necessary. It is specified that, in the context of the performance of their services, third parties have only limited access to the data and are contractually obliged to use it in accordance with the provisions of the applicable legislation on the protection of personal data;
- Apart from the cases set out above, Empow'Her undertakes not to sell, rent, transfer or give access to third parties to data without the prior consent of the User.
Article 10 : Use of Cookies
The User is hereby informed that cookies may be stored on his/her computer during visits to the Platform. A cookie is a text file that does not allow the User to be identified, but is used to record information about the User's browsing on the Platform. The purpose of these cookies is to analyze traffic patterns in order to improve the quality of the site.
The User may accept or refuse the installation of these cookies when browsing the Platform for the first time.
